The Communiqué on Increasing the Monetary Limits in Article 68 of the Consumer Protection Law No. 6502 and Article 6 of the Regulation on the Consumer Arbitration Committees has been published with the Official Gazette dated 16 December 2022 and numbered 32045. As of the date of 1 January 2023, the monetary limits effective for the application to the consumer arbitration committees will be increased and thus the scope of the disputes to be heard by the consumer arbitration committees would be extended in accordance with the Communiqué.
While the monetary limit for the application to the consumer arbitration committees is being 30.000,00 Turkish Liras –with the latest amendment dated 1 October 2022– as of the date of this legal update, the relevant monetary limit will be applied as 66.000,00 Turkish Liras as of 1 January 2023 pursuant to the provision of the Communiqué. In other words, it will be compulsory to resort to consumer arbitration committees for the consumer disputes that are valued below the 66.000,00 Turkish Liras with effect from 1 January 2023.
It bears importance for the persons who will commence the procedures of legal dispute resolution based on consumer transactions to take the increased monetary limits which are effective from 1 January 2023 into consideration while formulating their strategy for their claims.
