Trading of Second-Hand Motor Land Vehicles is Restricted

Certain amendments are made in The Regulation on the Trade of Second-Hand Motor Land Vehicles dated 13 February 2018 with the provisional article added as per “The Amendment on the Regulation on the Trade of Second-Hand Motor Land Vehicles” which has published and entered into force with the Official Gazette dated 16 August 2022 and numbered 31925.

With the provisional article added to the Regulation, it has been regulated that the traders who are dealing in second-hand motor land vehicles are forbidden to directly or indirectly sale or market the automobiles and land vehicles before the date of 1 July 2023, only if the time period of 6 months have not passed from their first registration and their milage are under 6.000 kilometres since their first registration date to Traffic Registry. Additionally, Ministry of Trade have been authorized to extend this period for an additional 6 months from the date of 1 July 2023 as stipulated with the Regulation.

Nevertheless, as an exception, it is regulated that automobiles and land vehicles that are registered before the date of 16 August 2022 are exempt from the abovementioned restriction as to the age and milages of the vehicle within the scope of the Regulation, provided that they are subjected to sales and marketing activities until the date of 15 September 2022.

Within this scope, it is evaluated that; the automobiles and land vehicles which are (i) registered to the Traffic Registry for the first time as of 16 August 2022 being the publishing date of the Regulation and under the limits of 6 month and 6.000 kilometres designated by the Regulation or (ii) while being under the relevant age and milage limits and although they have been registered to the Traffic Registry before 16 August 2022, that have not been subjected to marketing or sales until the date of 15 September 2022, will be subject to the abovementioned restriction for their second-hand marketing and sales until the date of 1 July 2023.

It is important for the businesses which their activities involve the trading of second-hand motor land vehicles to complete the transactions of sales and marketing as per the time limitations for second-hand sales introduced by the Regulation and act in accordance with the changes in the legislation in this regard.
